These Terms & Conditions ("Terms") govern your use of the DWORKS Media website and services. By accessing our site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By using our website or purchasing any service, you confirm that you accept these Terms and agree to comply with them. If you are entering into an agreement on behalf of a company, you represent that you have the authority to do so.

2. Services

DWORKS Media provides web design, development, branding, marketing, photography, video, and related digital services. The specific scope, deliverables, and pricing of each project are defined in a separate service agreement or proposal agreed between the parties.

3. Quotes & Estimates

All quotes are valid for 30 days unless otherwise stated. Estimates are provided in good faith based on the information available at the time; final pricing may vary if project scope changes. Any changes requested after a quote is accepted may result in additional charges.

4. Payment Terms

Unless otherwise agreed, a 50% deposit is required to begin work, with the balance due upon completion. Invoices are payable within 14 days. Late payments may incur interest at 1.5% per month. The deposit is non-refundable once work has commenced.

5. Client Responsibilities

• Provide accurate, timely information and content required for the project.
• Review deliverables and provide feedback within agreed timeframes.
• Ensure you have the rights to any content or assets you provide.
• Grant necessary access to systems, accounts, or platforms as needed.

Delays caused by the Client may affect timelines and budget. DWORKS is not liable for delays or issues arising from incomplete or late Client deliverables.

6. Intellectual Property

Upon receipt of full payment, ownership of final deliverables created specifically for the Client transfers to the Client. DWORKS retains the right to use the work for portfolio and marketing purposes unless otherwise agreed in writing. Third-party assets, fonts, and plugins remain subject to their respective licenses.

7. Revisions & Approvals

Each project includes a defined number of revision rounds as stated in the service agreement. Additional revisions or changes beyond the original scope are billed at an agreed rate. Final approval of deliverables is the Client's responsibility.

8. Project Timeline

Project timelines are estimates based on agreed scope and timely Client cooperation. DWORKS will make reasonable efforts to meet deadlines but is not liable for delays caused by factors outside its control, including late feedback or content from the Client.

9. Limitation of Liability

To the maximum extent permitted by law, DWORKS Media is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim is limited to the total fees paid by the Client for the services giving rise to the claim.

10. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the project and to use it solely for the purpose of delivering the agreed services.

11. Termination

Either party may terminate the engagement with written notice. Upon termination, the Client pays for all services rendered up to the termination date. Work completed and deliverables prepared remain payable and, where applicable, transferable upon payment.

12. Governing Law

These Terms and any service agreements are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.

13. Changes to These Terms

We may update these Terms at any time. The updated version takes effect when posted on this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
